    1. Our Websites are operated by Fossil Partners, L.P. We are a Texas limited partnership located at 901 S Central Expressway, Richardson, TX USA 95080. 
  2. GLOBAL-E
    1. Our Website uses third-party provider Global-e US Inc. (“Global-e”) as our sales and fulfillment partner. Global-e will be the seller of record for all contracts for the purchase and sale of products from the Websites. This means that Global-e will take your payment and deliver your order via a network of approved carriers. 
    2. If you purchase products from our Website(s), Global-E will collect and use your Personal Information for the purposes of fulfilling your order and delivering products to you. Please refer to the Global-e's Privacy Policy on their website (which is also available at checkout) for further details on how your Personal Information will be used by Global-e.
  3. PERSONAL INFORMATION WE COLLECT 
    1. “Personal Information” is information that can be used either directly or indirectly to identify you. The Personal Information we may collect about you depends on your interactions with us and our websites. We may collect the following categories of Personal Information:

      2. Transaction information you provide when you request information, contact customer service or purchase, return, request, or exchange a product or service from us, such as your postal address, telephone number, name and payment information;

      5. Usage, viewing, technical, and device data when you visit our sites. Every time you visit our website, our system stores Personal Information related to your browser, its version, the operating system of your computer, your IP address, date, length and time of your visit, the website you accessed before and the sites you visit following links on the Fossil page.   4. HOW WE USE YOUR PERSONAL INFORMATION 
    1. In order to provide you with our services and the full range of features, we and our service providers may collect and use your Personal Information for the following purposes:
      1. Provide you with the products and services you request, view, engage with on our websites; 
      2. Communicate with you about your customer account and your transactions on our Websites, as well as send you information about features on our sites or changes to our policies;
      3. Email you personalized reminders, offers and promotions for our products and services if you opted in for those, including emails about cart abandonment; 
      4. Text message you personalized reminders, offers and promotions for our products and services (only where you opt-in to receive such text messages);
      5. Support a customer loyalty program, as well as gift cards, referrals and discounts; 
      6. Personalize website content, including product recommendations; 
      7. Operate, understand, optimize, develop, or improve our sites, products, services and operations, including by using guest survey research and analytics tools; 
      8. Detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal;
      9. Notify you of product recalls or safety issues; 
      10. Share, publish and/or repost pictures and other materials you share with us via social media; 
      11. Administer contests, sweepstakes and other promotions sponsored by us; and
      12. Link the different devices you are using to save your preferences, analyze your usage of our websites, provide interest-based advertising to you and deliver tailored ads across multiple devices.
  5. HOW WE OBTAIN YOUR PERSONAL INFORMATION 
    1. From you. Most of the Personal Information we process, we received from you or your actions, be it because you provided us Personal Information (i) during the account creation process, (ii) to make a purchase or customer service request and/or (iii) to participate in other capabilities, such as receiving direct marketing, leaving a reviews, or participating in a sweepstake.
    2. Through the use of certain technologies. We collect information through a variety of technologies, such as cookies, Flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons. Our websites and apps use technology provided by a third-party service provider, Content Square, Inc. (“ContentSquare”), to track mouse movements, clicks and mobile interactions. The tracking data is securely sent to ContentSquare servers, where it is aggregated and prepared for analysis. ContentSquare then provides us with actionable insights and recommendations, which help us to improve our website and app experiences and better market our products. 
    3. From other Fossil Group companies. We may receive your Personal Information from other Fossil Group companies, if you previously shared any Personal Information with them.
    4. Through third party sources. We may receive information about you from third party sources, such as publicly-available websites, service providers and partners (e.g., Facebook, Google, etc.).
 
  1. WHO WE SHARE YOUR PERSONAL INFORMATION WITH
    1. We will share your Personal Information in the following cases: 
      1. Legal Obligation and Internal Purposes
        1. We disclose your Personal Information: 
          1. order to comply with relevant laws, regulatory requirements and to respond to lawful requests, court orders, and legal processes, including requests to meet national security or law enforcement requirements; 
          2. in order to protect and defend the rights or property of us or third parties; and/or 
          3. in an emergency, in order to protect the safety of our employees or any person.
      2. Joint Processing within Fossil Group, Inc. Your information will be combined with other Personal Information that Fossil Group companies have obtained about you (e.g. goods you have purchased on a company website or from a store, repair transactions). We base this joint processing on an intra group agreement, allocating the responsibilities of the respective group entities. According to this agreement, each Fossil Group company will be responsible for the data processing related to its own business operations and will remain responsible for the Personal Information jointly processed with others. For you as our customer this means that the Fossil entity you are in touch with is responsible for processing your data and answering your requests.       3. Links to Third-Party Websites & Services. On some pages we allow you to share Personal Information with third parties, such as social networks like Facebook. In these instances you are agreeing to the data being shared and the shared data being subject to the privacy policies of the third party. We do not control and do not assume any responsibility for the use of Personal Information by such third parties. For more information about the third party’s purpose and scope of their use of Personal Information in connection with sharing features, please visit the privacy policies of such third parties.
      4. Third-Party Advertising. We use third-party service providers to display advertisements across the internet. These advertising service providers may collect information about your visits to our website and your interaction with our products and services, as well as your visits to other websites. Such information does not include your name, address, email address, but may contain browser-related information.
      5. Public Disclosure. Any Personal Information that you include in the text of a product review may be made public in the product review section of our product pages. We may also make your wish list public on our website if you enable this function. 
      6. Sharing with Third Parties. We involve other companies for the provision of services, who are allowed to use Personal Information only on our behalf and must not use it for their own purposes, unless permitted by law.         2. to provide customer care services (e.g. Salesforce, 8x8, Transcosmos);

  1. HOW LONG WE KEEP PERSONAL INFORMATION 
    1. We will retain your Personal Information as long as necessary to provide you with functionality and services as described above under section 1, as long as reasonably necessary to further our legitimate interests or as long as we are required by law. Examples include the defense against, or the establishment of legal claims and legal obligations (e.g. tax law, or the principle of accountability, which requires us to demonstrate that our processing complies with applicable data protection laws). In order to verify whether you opted out or in to marketing activities, for example, we store your respective choice (e.g. via a cookie or a declaration).
  2. HOW WE KEEP YOUR PERSONAL INFORMATION SAFE
    1. We have implemented physical, organizational, contractual and technological security measures with a view to protecting your Personal Information and other information from loss or theft, unauthorized collection, use and disclosure.

      1. Legal Basis for Processing
        1. Please find below the legal basis for every processing activity as required in the EU and the UK according to the EU General Data Protection Regulation (EU) 2016/679 (GDPR) and the retained EU law version of the General Data Protection Regulation (UK GDPR), both hereinafter referred to as GDPR. As far as this processing is necessary for the performance of the contract with you, it is based on Art. 6 (1) b GDPR. On Art. 6 (1) f GDPR (legitimate interests) we base the processing of: 
          1. voluntarily provided information to offer a functionally appealing and user-friendly services website,
          2. data gained from video surveillance to improve our service and for security, loss and fraud prevention,
          3. data related to a credit check to offer different ways for payment,

Personal Information we collect will be primarily stored in the United States with Fossil Group member companies and our service providers, some of which are located in countries outside the EU and the UK. Your information may thus be subject to U.S. and foreign laws and accessible to U.S. and foreign governments, courts, law enforcement and regulatory agencies.
        2. In all cases we ensure an adequate level of data protection. We use contracts with standard contractual clauses, approved by the European Commission. If necessary we supplement them with adequate security measures with the aim of restricting access by foreign authorities in such a way that these principles comply with EU and UK law. We don’t use standard contractual clauses in case we transfer your Personal Information to a country that was officially recognized by the EU as having adequate protection for processing of Personal Information or pursuant to another exception allowing the transfer as permitted by applicable law.
