Terms of Participation and Privacy Information

These present Terms of Participation stipulate the applicable Conditions of the Fossil Harry Potter x Fossil Contest and provide information about the raising and using of data submitted by Participants. It is very important that these Conditions are read carefully before entering the Contest. By participation, all Participants agree to be bound by these Conditions and the decisions of the Organiser, which are binding and final in all matters relating to this Contest.

  1. Organiser
  2. The Contest is promoted by Fossil UK Ltd, Featherstone Road, Milton Keynes, GB MK12 5TH (hereinafter “Organiser”).

  3. Entry Period
  4. The Contest begins on the 8th November 2022 at 08.00 AM GMT and ends on the 14th November 2022 at 11.59 PM GMT (herein after “submission period”). The Organiser's computer is the official time keeping device for this Contest. Participants are responsible for determining the corresponding time zone in their respective jurisdictions.

  5. Eligibility
  6. Entitled to participation are persons domiciled in the United Kingdom who have reached the legal age of majority based on the laws applicable in said country at the time of entry.
    Employees of Fossil Group Inc., and their subsidiaries and affiliated companies as well as the employees’ immediate family (spouses, parents, siblings and children) and household members are not eligible.
    Proof of eligibility must be provided upon request.

  7. Prize
  8. The winner will receive one Harry Potter x Fossil Gryffindor Watch valued at £​189.
    Payment of the prize in cash, its asset value, its exchange or its transfer to other persons is not possible.

  9. Participation
  10. To participate the participant will need to click the participation button in the newsletter e-mail. Participants are not allowed to participate multiple times.
    No purchase is required to enter or win the Contest.

  11. Winner
  12. The winner will be determined on 15th November 2022.

    There will be one winner, domiciled in the United Kingdom. The winner will be drawn from all eligible entries.

    Organiser reserves the right, in its sole discretion, to reject, disqualify, modify, edit, and revise entries, comments, photos, or related materials that Organiser deems to be obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that Organiser believes may violate any applicable law or regulation or the rights of any third party.

  13. Winner Notification
  14. The winner will be notified by email within 7 working days. If the winner does not answer within 7 days, the prize will be forfeited and, at Organizer’s discretion, a runner-up winner may be selected. Organiser shall have no liability for winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.
    The winner is obliged to provide a valid delivery address in the United Kingdom and within 7 days since notification by the Organiser otherwise the prize will be forfeited and, at Organiser’s discretion, a runner-up winner may be selected. Organiser will bear the delivery costs. The winner is responsible for all applicable national, federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided.

  15. Data privacy Information
  16. Organiser will process personal data Participants provide in order to conduct the Contest as described in these Conditions.

    Organiser will use such data

    (i) in order to conduct the Contest (e.g. selecting the winner),[1]

    (ii) for marketing purposes (e.g. sending Participants' marketing material),

    (iii) in the case Participants agree to such use, for the publishing of submissions. The consent may in each case be withdrawn at any time,[2]

    (iv) based on its legitimate interests in (a) offering personalised services to combine the data with other data of the Participant as further described in the Organiser's privacy policy https://support.fossilgroup.com/s/article/FOSSIL-GLOBAL-PRIVACY-POLICY-1616590591948?language=en_GB, or (b) inviting Participants to join other contests.[3]

    Participants can object to the processing of their data for marketing purposes at any time by sending an email to: privacy@fossil.com. For questions related to the data processing the Participants may get in touch with the Organiser’s data protection officer via privacy@fossil.com.
    Apart from that Participants may request from Organiser access to the data, its deletion or correction, restriction of the processing and data portability. Participants may also file a complaint with the competent supervisory authority.   17. Disclaimer of warranty
  18. The Organiser points out that the availability and function of the Contest can not be guaranteed. The Contest may be terminated or removed due to external circumstances or constraints without this entitling the Participants to the Organiser. This shall include technical problems, rule changes or decisions by platforms such as Facebook.

  19. Liability
  20. Any compensation obligation of the Organiser and its executive bodies, employees and vicarious agents from or in connection with the competition, for whatever legal reason, is limited to cases of intent or gross negligence, to the extent permitted by law.

  21. Disputes
  22. This Contest is governed by the laws of England and Wales without regard to its conflict of laws rules. Any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before the Courts of England having jurisdiction. Mandatory applicable consumer protection regulations and laws not amendable by contractual agreement remain reserved.
    Further, in any such dispute, under no circumstances shall the Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

  23. General Conditions
  24. Organiser reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Organiser’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Organiser in its sole discretion. Organiser reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of the Contest or to be acting in violation of these conditions or in an unsportsmanlike, offensive or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal or civil law, and, should such an attempt be made, Organiser reserves the right to seek damages from any such person to the fullest extent permitted by law. Organiser’s failure to enforce any term of these conditions shall not constitute a waiver of that provision.
    Legal action shall be ruled out.
    If individual provisions should be or become invalid, this shall not affect the validity of the remaining terms and conditions of participation. These terms and conditions of participation can be changed by the Organiser at any time without any special notification.
